PUBLIC NOTICE OF UNDERSTANDING AND INTENT

  • To:
    • The Honourable Richard Wagner, Chief Justice of Canada,
    • Justice Andromache Karakatsanis and Wallace G. Craig of the Judicial Review Board of the Supreme Court of Canada
    • The Honourable, Minister of Public Prosecutions George Dolhai
    • The Honourable Mickey Amery, Attorney General of Alberta
    • The Honourable Arif Virani, Attorney General of Canada


 


  • Re: Malicious Prosecution and Arbitrary Detention of Anthony Olienick and Chris Carbert

    • The Canadian Democratic Defence Association (CDDA) hereby issues this official public notice of understanding and intent regarding the malicious prosecution and arbitrary detention of Anthony Olienick and Chris Carbert.

UNDERSTANDING
  • The CDDA understands that:
    • Anthony Olienick and Chris Carbert have been arbitrarily detained without bail for two years under conditions that violate the definition of torture in Canadian law.
    • The police used unethical tactics without warrant to solidify a case they knew they would otherwise lose contrary to
       
      • SEC 139 CC, SEC 122 CC, SEC 137 CC.
        Political interference by the federal government has compromised the administration of justice.
         
      • SEC 144 CC
  • Despite being found not guilty of the INITIAL allegations of which they were both acquitted for (conspiring to murder police) they were found guilty of lesser charges that came about during the investigation of the original charges they were acquitted for including mischief and possessing a weapon for a dangerous purpose. The Court then issued a further sentence of 6 and 6 1/2 years contrary to the doctrine of "fruit of a poisonous tree"
  • Anthony Olienick's legitimate use of homemade contraptions as a stone mason was misrepresented as evidence and much of the case was grounded in unethical heresay between the unethical and without warrant communications of an officer and one of the defendants.



INTENTION
  • The CDDA intends to:
    • Pursue all available legal avenues to address this malicious prosecution and arbitrary detention.
    • Advocate for the rights of Anthony Olienick and Chris Carbert and ensure justice is served.
    • Hold accountable those responsible for this abuse of process, including police and government officials.
    • Restore public trust and confidence in the justice system.



CALL TO ACTION
  • The CDDA calls upon the aforementioned authorities to:
    • Conduct a judicial review of this case.. Chief Justice Wagner.
    • Investigate and take disciplinary action against Prosecutor Steven Johnston and involved police officials.
    • Review and ensure that the Alberta judiciary upholds the highest standards
    • Review and ensure that Canada's judiciaries uphold the highest standards, free from political interference Justice David Labrenz.

  • The CDDA is committed to protecting the integrity of the justice system and restoring public trust.
